1. Acceptance of Terms

By accessing or using the Loqa platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use Loqa. By creating an account, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use the Service.

3. Your Account

You are responsible for maintaining the security of your account credentials. You agree to:

• Provide accurate and complete registration information
• Keep your password confidential and not share it with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use Loqa to:

• Post or transmit illegal content, including but not limited to child exploitation material
• Harass, bully, threaten, or intimidate other users
• Distribute malware, phishing links, or other harmful software
• Spam, flood, or disrupt channels and servers
• Impersonate other users, organizations, or Loqa staff
• Circumvent rate limits, bans, or security measures
• Use automated tools (bots) in a way that degrades service for others
• Violate any applicable local, national, or international law

5. User Content

You retain ownership of content you create and share on Loqa. By posting content, you grant us a limited, non-exclusive license to store, transmit, and display that content as necessary to operate the Service.

You are solely responsible for the content you post. We do not pre-screen content, but we reserve the right to remove content that violates these Terms or applicable law.

6. Bots & Integrations

Loqa supports bot accounts and third-party integrations. Bot developers must:

• Comply with these Terms and our API usage guidelines
• Not abuse API rate limits or consume disproportionate resources
• Clearly identify their bot as automated (not impersonate a human)
• Respect user privacy and only collect data with explicit consent

We reserve the right to revoke API access for bots that violate these guidelines.

7. Voice, Video & Screen Sharing

When using voice, video, or screen sharing features:

• You consent to transmitting your audio/video stream to other participants in the channel
• You must not record other participants without their explicit consent
• You must not share illegal, harmful, or NSFW content via screen sharing in channels that do not permit it

8. Server Moderation

Server owners and moderators are responsible for enforcing community standards within their servers. While Loqa provides moderation tools, we are not responsible for user-generated content within individual servers.

Server owners must ensure their communities comply with applicable laws and these Terms. We may take action against servers that systematically violate our policies.

9. Intellectual Property

The Loqa platform, including its design, code, logo, and branding, is the intellectual property of Loqa and is protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Termination

You may delete your account at any time through your account settings. We may suspend or terminate your access to the Service at our discretion if you violate these Terms, without prior notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

We are not liable for any content posted by users, third-party integrations, or bots operating on the platform.

12. Limitation of Liability

To the maximum extent permitted by law, Loqa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.

13. Copyright & DMCA

We respect the intellectual property rights of others. If you believe that content on Loqa infringes your copyright, you may submit a takedown notice to our designated agent at [email protected] with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of where the infringing material is located on our Service
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and notify the user who posted it. Repeat infringers may have their accounts terminated.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware.

15. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA).

You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Loqa.

Small claims exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

16. Changes to These Terms

We may modify these Terms at any time. We will notify users of material changes via the platform or email. Your continued use of Loqa after changes take effect constitutes acceptance of the revised Terms.
